Wanted Felon Leads Deputies on Overnight Chase

On July 19, 2022, at approximately 12:22 AM, Precinct 8 Deputy B. Claunch and Deputy B. Muschweck with Constable Sandlin’s Office attempted to make a traffic stop on a white Buick Regal for speeding near the Gulf Freeway and Park Place Blvd. The vehicle failed to yield and the driver evaded Deputies northbound on the Gulf Freeway. Once near State Highway 228 and the Gulf Freeway interchange, the driver threw a pistol from the window of the vehicle and continued travelling north until he took the Interstate 10 exit to go west towards Katy. The driver continued west on I-10 until he exited at Cane Island in the 28420 block of I-10. The driver drove off the roadway from the service lanes through a grassy median. Officers with the Houston Police Department, who were assisting in the pursuit, attempted to PIT the vehicle. As Deputy Muschweck followed, his patrol car became unstable on the rough terrain, causing both side air bags to deploy. HPD continued to follow and pursue the suspect who ultimately crashed into an Amazon warehouse building causing damage to the facility and rendered his vehicle disabled. The suspect was placed into custody after a brief standoff where he initially refused to get out of the car.

The driver was identified as 41 year old Justin Dupree Tolliver. A female, who was a passenger in the vehicle during this pursuit, was later released from the scene and will not face any criminal charges. The .380 pistol that Tolliver threw from the vehicle was recovered and submitted as evidence. Deputies also located numerous Xanax pills in Tolliver’s vehicle. A check of the suspect revealed he had an open Parole Violation warrant through Texas DPS for Homicide. The Harris County District Attorney’s Office was contacted and accepted felony charges of Evading Arrest in a Motor Vehicle and Felon in Possession of a Firearm in this case. Charges for Possession of a Controlled Substance were declined. At this time, Tolliver is awaiting a court appearance and bond has not yet been set.

Deputies Claunch and Muschweck were evaluated and treated for minor injuries as a result of the air bag deployment. Constable Sandlin would like to thank the various law enforcement agencies that assisted in the capture of this dangerous felon, including members of the Houston Police Department and the Katy Police Department. “I am thankful for the men and women of area law enforcement who work collaboratively every day to serve our community and who put their lives on the line to keep the public safe. I am especially thankful that my Deputies, nor anyone else, were seriously injured in this chase”, Sandlin said.
